Terms and Conditions
Terms of business for container sales. These are a template covering the points this trade normally needs; the final wording must be settled with a qualified adviser.

Scope
These terms apply to the sale of shipping containers and related services to business customers. Terms proposed by a customer do not apply unless expressly agreed in writing.
Quotations and orders
Quotations are non-binding until confirmed in writing, and are valid for the period stated on them. Container availability at depot changes continuously; a quotation reflects availability at the time it is issued and is subject to the specific unit remaining unsold.
A contract comes into existence on written order confirmation.
Condition descriptions
Containers are sold by condition grade. The meaning of each grade used in our offers is set out in the container conditions guide.
Grades other than IICL are trade conventions rather than certifications. Used containers may show cosmetic damage, repairs and mismatched paint consistent with the grade offered. Technical specifications published on this website are nominal figures for the type; the governing figures for an individual unit are those on its CSC safety approval plate.
Inspection
Where depot inspection is available for a unit, it must be arranged before dispatch. Requests for inspection after delivery do not suspend payment obligations.
Delivery and access
Delivery dates are estimates unless expressly agreed as binding. The customer is responsible for ensuring that the delivery address is accessible to the agreed vehicle type, that ground conditions are adequate, and that a prepared standing position and a person able to direct placement are available at the agreed time.
Where delivery fails because these conditions are not met, the resulting costs are chargeable.
Prices, taxes and Incoterms
Prices are exclusive of VAT unless stated otherwise. Intra-EU supplies are treated in accordance with the applicable VAT rules against a valid VAT identification number.
Overseas supplies are made on the Incoterms stated in the quotation. Import duties, destination port charges, customs clearance and inland transport beyond the named destination are the buyer's responsibility unless expressly included.
Retention of title
Goods remain our property until payment has been received in full.
Warranty and liability
Statutory warranty rights apply subject to the condition grade agreed. Used goods are sold on the basis of the grade described, and characteristics consistent with that grade do not constitute defects.

Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods where the parties so agree. Place of jurisdiction for business customers is to be stated here once confirmed.
